By accessing or using junkDrawer.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

junkDrawer.ai provides AI-powered search tools for eBay buyers and seller tools for eBay sellers. We are an independent third-party application that uses eBay's APIs with proper authorization through the eBay Partner Network and eBay Developer Program. We are not operated by, affiliated with, or endorsed by eBay Inc.

3. eBay Policy Compliance

CRITICAL: You must comply with all eBay policies, terms of service, and community guidelines. Any violation of eBay policies through your use of our Service is strictly prohibited and may result in immediate termination of your account.

• You agree to follow all eBay User Agreement and policies
• You will not use our Service to violate eBay's terms of service
• You are responsible for ensuring your eBay listings comply with eBay policies
• We reserve the right to terminate accounts that violate eBay policies

4. User Accounts

When you create an account, you must provide accurate and complete information. You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

• You confirm you have legal capacity to enter into these Terms and are at least 18 years old
• You will keep your account information accurate and up to date
• You will not create accounts using bots or other automated methods

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Use automated tools to access the Service without permission (scrapers, spiders, bots)
• Interfere with the Service's operation or other users' access
• Reverse engineer, copy, or bypass security or rate limits

6. Uploads and License

If you upload content (including images) you represent and warrant you own it or have rights to use it. You grant us a limited, worldwide, non-exclusive license to host, process, and display that content for the purpose of providing the Service. You retain all ownership of your content.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by junkDrawer.ai and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. eBay trademarks belong to eBay Inc.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or usefulness of any information from eBay or third parties. We are not responsible for any transactions between you and eBay or other users.

9. Limitation of Liability

In no event shall junkDrawer.ai be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

10. Services Management

We may monitor, remove content, rate-limit, and suspend or terminate access as needed to protect the Service and users. We may modify, suspend, or discontinue parts of the Service without notice.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Dispute Resolution

Before filing any claim, the parties will attempt to resolve disputes informally for 30 days. You agree to resolve disputes individually, and waive participation in class actions. Venue is San Francisco County, California.

14. Indemnification

You agree to indemnify and hold harmless junkDrawer.ai and its affiliates from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, violation of eBay policies, or infringement of third‑party rights.

15. Electronic Communications

You consent to receive communications electronically. Electronic signatures and records are equivalent to handwritten signatures and paper records.

16. User Data

We may retain operational data to run the Service. You are responsible for maintaining your own backups of your content and data. We are not liable for loss or corruption of such data.

17. Third‑Party Services

The Service may contain links or integrations with third‑party services (including eBay). Their terms and privacy policies apply in addition to these Terms. We do not control or assume responsibility for third‑party services.

18. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in San Mateo County, California.
